This article explains the effectiveness of new courts for sex offenders. These courts have been shown to reduce recidivism, the repetition of crimes, so they are positive both for the community at large and for individual offenders. The article suggests that these courts be expanded because of their judicial efficiency and reduced recidivism.
The article offers an overview of sexual offense laws and crimes. Laws against sex offenders have become more stringent in recent years, as federal laws such as the Jacob Wetterling law require states to compile registries of sex offenders. Megan's Law, passed in 1996, requires states to make these registries partially available to the public. Title I of the Adam Walsh Act is called the Sex Offender Registration and Notification Act, which established the standards for sex offender notification and registration.
The article states that these registries are not always well compiled and are more difficult to administer than they might seem. In fact, there are so many sex offenders (one in 150 men in the United States) that it is unwieldy. The article presents statistics about sex offenders, who are primarily white men, and their victims, who are largely female. Recidivism rates for sex offenders are surprisingly low (about 24% over a 15-year period, page 457).
Sex offense courts are what the article refers to as "problem-solving courts," which can adjudicate sex crimes with greater efficiency, specialization, and cost savings. The first sex offense court was opened in New York. The article states that these courts should be expanded because of their efficiency, and it discusses the functions of these courts, which includes risk assessments of offenders and monitoring of offenders. These courts also allow relationships between offenders and judges, the courts provide outreach to victims. The article explains the advantages of these courts over other jurisdictions and makes recommendations for future courts.
